Andres Rodriguez left the TJ Maxx store on East 174th and Vyse Avenue shortly before 5pm on May 17, and someone fired on the street.
Rodriguez was shot in the ass on his way home from shopping.
“He’s doing very well,” said his son Miguel Rodriguez earlier this month. “Thanks to God. Everything wasn’t worse than ever.”
The shooting was recorded in a surveillance video, and police identified Darryl Burnett and the criminal who self-confessed on Friday morning.
Jimmy Essig, NYPD detective director, said Burnett had spoken and then fired at someone in a black car and escaped.
“Witnesses asked,’What are you going to do?'” Esig said. “And a man in the corner said,’I’ll show you what I’m doing.’ He takes out a 9 mm handgun and fires three shots.”
Burnett has been charged with attempted murder, assault, reckless danger, criminal possession of weapons, and harassment.
He was ordered to pay $ 100,000 in bail after appearing in court in Bronx on Friday.
