Wilpepe, 31, will be detained Tuesday afternoon and will appear in federal court in White Plains.
MTA employees were recognized by both colleagues and management from photos distributed by law enforcement agencies.
The MTA’s management has moved swiftly, Pepe has been suspended unpaid and will be prosecuted this week.
“The individual will be immediately unpaid from Metro-North and will be disciplined in accordance with collective bargaining agreements until an investigation is conducted,” said Ken Lovett of the MTA. “This alleged act is abominable and contrary to Metro-North, New York, and national values.”
Pepe was called ill last Wednesday to attend a protest by the Capitol, which was a misuse of sick leave.

31-year-old Pepe was hired six years ago.
He is a worker assigned to a machine shop in Putnam County.
