Planned lawsuit against Hawaiian Airlines over turbulent flight

Honolulu (KHON2) — At least 12 passengers plan to file a lawsuit against Hawaiian Airlines over a flight hit by severe turbulence that injured dozens.

Lawyers question whether the pilot and co-pilot took the necessary precautions to avoid injury.

On December 18, 2022, Hawaiian Airlines Flight 35 from Phoenix experienced severe turbulence 40 minutes after landing in Honolulu, causing passengers to lift from their seats. Twenty people were taken to hospital, according to Honolulu Emergency Medical Services.

A lawyer representing the 12 injured passengers said the captain knew he was about to experience severe turbulence and should have ordered all passengers and crew to sit down and fasten their belts. .

“It simply wasn’t done on this flight — and that’s what it should have been done on this flight. And if it had been done, no one would have been hurt,” the attorney said. Nomaan Hussein said.

Husain is the founder of Husain Law and Associates, a Texas law firm that specializes in aviation law. They are currently working on a Boeing 737 Max lawsuit.

He said his legal team is now investigating whether the crew took the necessary precautions. You said you issued a weather bulletin.

“If they knew it, what did they do about it? Did they ask the airline if they could deviate from the flight path? Did you just decide to continue the flight path?” Hussein said.

He said his clients suffered various injuries.

“We have clients with broken bones. We have clients with herniated discs. We have clients with neck and back injuries. It’s been diagnosed,” Hussain said.

The day after the incident, Hawaiian Airlines said it was aware of forecasts and unstable air, but had no warning that the particular patch of air where the turbulence occurred was dangerous in any way.

According to preliminary NTSB reports, the captain saw clouds rising towards the aircraft in seconds and did not have time to deviate.

Hussein said further investigations are underway before filing a lawsuit. A Hawaiian Airlines spokeswoman said she could not comment because the NTSB investigation was ongoing.
