South Korea’s justice ministry instructed prosecutors on Thursday to apply for review at the Seoul High Court after it determined there were “probable grounds” to believe the suspect committed the crime.

If the court rules in favor of her extradition, South Korean Attorney General Han Dong-hoon will make the final decision on whether she will be sent to New Zealand.

Lee Ji-hyun, an official with the ministry’s international crime division, said prosecutors are likely to apply for review this week and the court will take two months to decide on the case.

South Korean police arrested an unidentified woman in a southern port city in September based on a domestic court warrant issued after New Zealand requested her provisional arrest. He formally requested the Ministry of Justice to extradite her.

New Zealand police say the South Korean warrant for the arrest of the suspect is linked to two murder charges and has asked South Korean authorities to keep the woman in prison until she is turned over.

The bodies of the children were found in August after a New Zealand family bought abandoned items, including two suitcases, from an online auction storage unit. said no.

The children, aged between 5 and 10, died several years ago and the suitcases had been stored in Auckland for at least three to four years, police said.

South Korean police said the woman was born in South Korea and then emigrated to New Zealand, where she obtained citizenship. According to her immigration records, she returned to South Korea in 2018.

South Korean police believe she may be the mother of the two victims, as her past address was registered in New Zealand in the warehouse where the suitcases were kept.
